1.1 About us

This website and the services offered through it are operated by Emma Darkin trading as S.A.M Pets Biz. Within S.A.M Pets Biz, S.A.M Pet Services provides pet-care services and S.A.M Pet Business Support provides mentoring, networking, memberships, training and digital resources for pet-business owners.

1.2 When these terms apply

These terms apply when you use this website, purchase a product, book a session or service, join a subscription or membership, or otherwise enter into an agreement with S.A.M Pets Biz.

Some services have additional terms. Pet-care clients enter into a separate pet-care service agreement. If these website terms conflict with a signed pet-care service agreement, the signed agreement takes priority for that pet-care service. Any specific written proposal, order page or booking confirmation also forms part of the agreement for the relevant purchase.

Nothing in these terms limits any statutory rights that cannot legally be excluded.

1.3 Eligibility and information you provide

You must be at least 18 years old and legally able to enter into a contract. You agree to provide accurate, complete and current information and to tell us promptly if relevant information changes.

Business mentoring, business resources, networking and the Pet Biz Success Hub are intended for people acting mainly for purposes connected with their trade, business, craft or profession. Pet-care services may be purchased by consumers for personal use.

1.4 Enquiries bookings and formation of a contract

Submitting an enquiry or contact form does not create a confirmed booking. A contract is formed when we expressly accept a booking or order, send confirmation, or begin providing the agreed service, whichever happens first.

We may decline a booking or purchase where a service is unavailable, unsuitable, outside our service area, incorrectly priced, or cannot reasonably or safely be provided. If payment has already been taken and we cannot accept the order, it will be refunded.

1.5 Prices and payments

Prices are shown in pounds sterling and will be confirmed before purchase. Any applicable taxes or additional charges will be identified before payment.

Payments may be processed by a third-party payment provider. You authorise us and the provider to take the payment or recurring payments shown at checkout. You are responsible for keeping your payment details current.

If a payment fails or becomes overdue, we may retry the payment, contact you, suspend access or pause future services until the account is brought up to date. We will not charge an undisclosed fee.

1.6 S.A.M Pet Services

Pet-care services may include dog walking, pet sitting, cat visits, small-animal drop-in care and adventure days. Availability, service area, frequency, price and arrangements are confirmed individually.

All pet-care clients must complete any required registration, pet-information, emergency-contact and veterinary-consent forms and enter into the separate pet-care service agreement before services begin. That agreement covers matters including access to the property, keys, pet health and behaviour, emergency veterinary treatment, cancellations, transport, walking arrangements and safety.

Clients must provide accurate information about their pet's health, temperament, medication, behaviour, routine and any known risks. A booking may be refused, suspended or ended where information has been withheld or where continuing the service would create an unreasonable risk to a person or animal.

Photos or videos of a client's pet will only be used in accordance with the permissions given in the pet-care paperwork and the Privacy Policy.

1.7 Business mentoring and support

Business support may include mentoring, guidance, training, social-media support, planning and other practical business assistance described on the relevant page, proposal or booking confirmation.

This support is educational and based on experience. It is not legal, financial, tax, accounting or other regulated professional advice. You remain responsible for your business decisions, legal compliance, insurance, finances and results.

Unless a written agreement states otherwise, booked one-to-one sessions may be rearranged subject to the cancellation terms communicated at booking. Missed sessions and cancellations made after the stated deadline are not normally refundable.

1.8 Networking calls workshops and events

Networking calls, workshops and events may be sold as one-off bookings, recurring subscriptions or included within a membership. The date, time, delivery method, content and price will be shown before purchase.

We may reasonably change a speaker, topic, time or delivery platform. If we cancel without providing a reasonable replacement, transfer or recording, we will offer an appropriate refund for the affected paid booking.

Attendees must behave respectfully and must not harass others, make unsolicited sales approaches, misuse contact information or disrupt a session. We may remove an attendee for serious or repeated misconduct without refund, subject to applicable law.

1.9 Digital products and free resources

Digital products and resources may include guides, templates, downloads, videos, recordings and other materials. Unless stated otherwise, they are supplied for the purchaser's own personal or internal business use only.

Digital delivery usually begins immediately after purchase. Where consumer cancellation rights apply, you will be asked to give express consent for digital content to be supplied during the 14-day cancellation period and to acknowledge that you may lose the right to cancel once supply begins.

If a digital file is faulty, materially different from its description or cannot be accessed because of an issue for which we are responsible, please contact us so we can provide a replacement, repair or other remedy required by law.

1.10 Pet Biz Success Hub membership

The Pet Biz Success Hub is a business-support membership for pet professionals. It may include mentoring, live training, networking, digital resources, recordings, community access and other benefits described on the sales or checkout page.

Membership access is personal, non-transferable and must not be shared. The content, schedule, contributors and delivery platforms may change where reasonably necessary. We will give notice of material changes where practical.

Monthly membership

A monthly membership renews automatically each month until cancelled. The recurring payment shown at checkout will be taken using the chosen payment method.

You may cancel at any time before the next payment is due. Cancellation stops future renewals and access continues until the end of the period already paid for. Payments for a billing period that has already begun are not normally refundable, except during an applicable cooling-off period or where required by law.

Annual membership

An annual membership is paid in full upfront and provides access for a fixed 12-month term. By selecting this option, you commit to the full year. After the applicable initial cooling-off period, cancellation or non-use during that year does not entitle you to a full or partial refund, except where required by law.

The annual membership renews automatically for a further 12-month term and the next annual payment will be taken using the payment method held on file. We will send a reminder before renewal containing the renewal date, price and cancellation information.

You must cancel before the renewal payment is taken if you do not want another annual term. Cancellation during the current term prevents the next renewal but does not end the current paid term. You will normally retain access until that term ends.

Following an annual renewal, you may cancel the renewed term within 14 days. If renewal services have already begun at your request, any refund may be reduced by a reasonable proportionate amount for the renewed services supplied before cancellation. No separate administration, cancellation or payment-processing fee will be deducted from a statutory refund.

Changes to membership prices

We may change membership prices. A price increase will not be applied retrospectively to a current paid annual term. Monthly members will be notified before an increased payment is taken. Annual members will be told the renewal price before renewal and may cancel before that renewal.

1.11 Cooling-off rights for services and memberships

Where you are legally a consumer and enter into a distance contract, you will usually have 14 days from the day after the contract is made to cancel without giving a reason. We also apply the membership cooling-off provisions stated above where they are included as a contractual benefit.

If you ask us to begin a service or membership during the 14-day cooling-off period, you expressly request early performance. If you then cancel during that period, we may deduct a proportionate amount for services supplied up to the time you told us you wished to cancel. If a service has been fully performed following your express request and acknowledgement, the statutory cancellation right may end.

The treatment of digital content is explained in section 1.9. Different statutory rules may apply to services booked for a specific date or to purchases made wholly for business purposes.

To cancel during a cooling-off period, email emma@sampets.co.uk or use the model cancellation form at the end of this document. An eligible refund will be made without undue delay and within 14 days, normally using the original payment method.

1.12 WhatsApp community

Access to any WhatsApp community is optional. Depending on your privacy settings, joining a WhatsApp group means your mobile number, display name, profile photograph, About information, messages and shared media may be visible to Emma and every other group member.

By choosing to join, you acknowledge that your mobile number and other visible profile information will be disclosed to other members for the purpose of operating the community. If you do not want your number to be visible, do not join the WhatsApp group. Declining WhatsApp access does not cancel the remainder of a paid membership.

Members must not add another member to a marketing list, send unsolicited sales messages, harvest contact details, share screenshots or disclose another person's information without permission. We cannot guarantee that another member will keep information confidential, so you should not post sensitive, confidential or commercially valuable information.

You may leave a WhatsApp group at any time. Information already posted may remain in other members' chat histories. WhatsApp is a third-party service with its own terms and privacy practices.

1.13 Online sessions and recordings

You will be told if an online session is being recorded. If you participate with your camera, microphone, display name or chat enabled, that information may appear in the recording. You may keep your camera and microphone off and avoid identifying contributions if you do not wish to appear.

Recordings may be made available to relevant members or purchasers. They must not be copied, published or shared outside the permitted audience.

1.14 Community conduct and suspension

Users and members must communicate respectfully. Bullying, harassment, discrimination, unlawful conduct, spam, aggressive selling, infringement of rights or deliberate disruption is prohibited.

We may remove content, issue a warning, suspend access or terminate access for a serious or repeated breach. Where access is ended because of the user's material breach, there is no automatic right to a refund, although statutory rights remain unaffected.

1.15 Intellectual property

Unless stated otherwise, website and service content, including text, graphics, guides, templates, recordings, videos and training materials, belongs to S.A.M Pets Biz or the relevant rights holder.

Purchasers receive a limited, personal, non-exclusive and non-transferable licence to use purchased materials for their own personal use or internally within their own business. You must not copy, resell, distribute, upload, teach from, licence, modify for resale or commercially exploit the materials without prior written permission.

Members retain ownership of material they create. By submitting content within a service, they grant us permission to display and use it only as reasonably necessary to deliver and administer that service. Testimonials, case studies or promotional photographs will not be published without appropriate permission.

1.16 Results and availability

We aim to provide accurate, useful information but do not guarantee a particular business result, income, number of clients, social-media performance or other outcome. Examples and testimonials illustrate individual experiences and are not promises of typical results.

We do not guarantee that the website or every third-party platform will always be available or error-free. We will take reasonable steps to restore services and provide appropriate alternatives where we are responsible for a material disruption.

1.17 Changes cancellation and events outside our control

We may make reasonable changes to services, schedules, platforms, contributors or content. We will give reasonable notice of a material change and will not remove a purchaser's statutory rights.

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, illness, power or internet failure, platform outages, emergencies or government restrictions. We will take reasonable steps to minimise disruption and rearrange, substitute or refund an affected paid service where appropriate.

1.18 Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to the paragraph above and applicable law, we are not responsible for losses that were not reasonably foreseeable when the agreement was made, losses caused by inaccurate or incomplete information supplied by you, or business losses arising from decisions you make using educational content.

If you purchase as a consumer, we provide services with reasonable care and skill and digital content of satisfactory quality, fit for purpose and as described, as required by law.

1.19 Complaints

Please send complaints to emma@sampets.co.uk. We will acknowledge and investigate them fairly and respond without undue delay. Data-protection complaints are handled under the complaints section of the Privacy Policy.

1.20 Changes to these terms

We may update these terms to reflect changes in law, technology or our services. The updated version will be published with a revised date. A material change will not retrospectively remove rights relating to a purchase already made. Where appropriate, members will be notified directly.

1.21 Governing law

These terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except where applicable consumer law allows you to bring proceedings elsewhere.

2. Privacy Policy

2.1 Who is responsible for your information

Emma Darkin trading as S.A.M Pets Biz is the data controller responsible for the personal information described in this policy. This policy applies across S.A.M Pet Services and S.A.M Pet Business Support.

Contact: emma@sampets.co.uk, 43 Windsor Crescent, Prestwich, M25 9DD.

2.2 Information we may collect

·        Identity and contact information, including your name, address, email address and telephone number.

·        Business information, including your business name, role, website and information you share when seeking support.

·        Transaction, billing, subscription and account information. Full card details are normally handled by the payment provider rather than stored by us.

·        Pet-care information, including your address, access instructions, emergency contacts, veterinary details, pet routines, health, medication, behaviour and service history.

·        Communications, enquiries, complaints, feedback and community contributions.

·        Photographs, video, audio, display names and chat contributions where relevant permissions have been given or a session is recorded.

·        Marketing preferences and records of consent.

·        Technical and usage information, including IP address, browser, device and cookie data.

·        Any other information you choose to provide.

Please avoid giving us unnecessary sensitive personal information. If health, accessibility or other sensitive information is genuinely needed to provide a requested service safely, we will handle it only where there is a valid legal basis and appropriate condition.

2.3 How we collect information

We may collect information directly from you through forms, bookings, purchases, emails, calls, questionnaires, sessions and community participation. We may also receive information through our website, payment and membership providers, analytics tools, social-media platforms, referral sources and publicly available business sources where lawful.

We use personal information to:

·        Respond to enquiries and take steps requested before entering into a contract.

·        Process purchases, confirm bookings, provide pet care, deliver business support and administer memberships.

Depending on the purpose, we rely on contract, steps taken before contract, legal obligation, legitimate interests or consent. Legitimate interests may include operating and improving the business, maintaining records, preventing misuse, securing systems and communicating with existing customers where their rights do not override those interests.

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing that was lawful before it was withdrawn.

2.5 WhatsApp and group visibility

Joining a WhatsApp community is optional. Your phone number and, depending on your settings, your display name, photograph, About information, messages and media may be visible to Emma and other members.

We use this information to provide and moderate the community. Do not join if you do not want your number disclosed to other members. Leaving stops future participation but does not remove information already delivered to other people's devices or retained in their chat histories.

Community rules prohibit members from using another person's details for unsolicited marketing or unrelated purposes, but we cannot guarantee another individual's actions. WhatsApp processes information under its own privacy terms and may process information outside the UK.

2.6 Photographs recordings and testimonials

Pet photographs are used in line with permissions given by the pet-care client. Members and session attendees will be informed before a recording begins. Public use of an identifiable testimonial, case study, image, video or recording will be based on appropriate permission or another valid legal basis communicated at the time.

Where necessary, we may share limited information with:

·        Website, hosting, membership and email-platform providers.

·        Payment processors and financial-service providers.

·        Professional advisers, accountants, insurers and IT support.

·        Veterinary professionals or emergency contacts where necessary for pet welfare and authorised under the pet-care agreement.

·        Government, courts, regulators, law enforcement or other parties where required or permitted by law.

·        A purchaser or successor if the business is sold or reorganised, subject to appropriate safeguards.

We do not sell personal information. Service providers may only use information for authorised purposes and must protect it appropriately.

2.8 International transfers

Some technology providers may store or access information outside the United Kingdom. Where data-protection law requires it, we use an appropriate safeguard, such as UK adequacy regulations, an approved contractual mechanism or another lawful transfer arrangement.

2.9 How long we keep information

We retain personal information only for as long as reasonably necessary for the relevant purpose, including legal, tax, accounting, insurance and dispute requirements.

·        Customer, service and membership records are normally kept for the relationship and an appropriate period afterwards.

·        Financial and transaction records are normally kept for at least the period required by UK tax and accounting law.

·        Marketing information is kept until you unsubscribe, withdraw consent or it is no longer relevant.

·        Complaints and legal records may be kept for as long as needed to resolve the matter and manage potential claims.

·        Recordings and community content are kept only while reasonably relevant to the purpose for which they were created, subject to copies already delivered to participants.

2.10 Security

We use reasonable technical and organisational measures to protect personal information from loss, misuse, unauthorised access, alteration or disclosure. No online service is completely secure. Users should avoid sharing unnecessary confidential or sensitive information in group spaces.

2.11 Your rights

Depending on the circumstances, you may have the right to access your information, correct it, request deletion, restrict processing, object to processing, receive certain information in a portable format, withdraw consent and complain about our use of your information.

Not every right applies in every situation. We may ask for information to confirm your identity. To exercise a right, email emma@sampets.co.uk.

You may complain if you are concerned about how we have collected, used, shared or protected your personal information. Email emma@sampets.co.uk with enough detail for us to understand the concern.

You may also complain to the Information Commissioner's Office at www.ico.org.uk or by writing to Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF. You may contact the ICO without first complaining to us, although we welcome the opportunity to resolve concerns directly.

2.13 Marketing

We send marketing emails where you have consented or where another lawful rule permits it. You may unsubscribe at any time using the link in an email or by contacting us. Administrative messages about a purchase, booking, account or subscription are not marketing and may still be sent where necessary.

2.14 Children

The website, business support and memberships are not directed at children. A parent or guardian must provide information and enter into any pet-care agreement where a person under 18 is involved. Please do not submit a child's information unless it is necessary and you have authority to do so.

2.15 Changes to this policy

We may update this policy when our services, technology or legal obligations change. The current version will be published with its updated date. We will give additional notice if a change materially affects how existing information is used.
